1. Introduction

These Terms & Conditions (“Terms”) govern your use of the Burst mobile application and related services (the “App” or “Service”), operated by [COMPANY LEGAL NAME] (“Burst”, “we”, “us” or “our”). By downloading, accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Burst is a tool for rideshare and taxi drivers that alerts you when events near your location are ending, so you can position yourself for passenger pickups.

2. Eligibility & accounts

You must be at least 18 years old and legally permitted to drive passengers for hire in your jurisdiction to use the App for its intended purpose. Burst does not currently require you to create an account or provide login credentials to use the App.

3. The service

The App uses your device location to identify nearby events and estimate whether you can reach a venue before an event ends, and sends you alerts based on the preferences you set (such as alert radius and timing).

Event information is sourced from third parties and is provided on an “as available” basis. Event times, venues and attendance are estimates and may change or be inaccurate. Burst does not guarantee the availability, accuracy, completeness or timeliness of any event information or alert.

4. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any local transport, licensing or traffic laws;
  • Interfere with, disrupt, or attempt to gain unauthorised access to the App or its servers;
  • Copy, reverse-engineer, decompile, or create derivative works from the App except as permitted by law;
  • Use automated means to scrape, harvest or extract data from the App;
  • Resell, sublicense or commercially exploit the App or its data without our written permission.

5. Driver safety

Your safety and the safety of others always comes first. Do not interact with the App while your vehicle is in motion. Only view alerts, the map, or directions when it is safe and lawful to do so, such as when parked or stopped.

Burst is a positioning aid, not a navigation or dispatch system. You are solely responsible for obeying all traffic laws, driving safely, and complying with the rules of any rideshare or taxi platform you drive for.

6. Intellectual property

The App, including its design, branding, text, graphics and software, is owned by [COMPANY LEGAL NAME] or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, professional driving use in accordance with these Terms. All rights not expressly granted are reserved.

7. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that alerts will always be delivered or be accurate.

Burst does not guarantee any level of income, number of fares, or business outcome from using the App.

8. Limitation of liability

To the fullest extent permitted by law, [COMPANY LEGAL NAME] shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of (or inability to use) the App. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

9. Changes & termination

We may modify these Terms or the App at any time. Material changes will be reflected by updating the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. We may suspend or discontinue the App, in whole or in part, at any time.

10. Governing law

These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless a different mandatory jurisdiction applies to you as a consumer.

11. Privacy Policy

This Privacy Policy explains what information Burst uses and how it is handled. We are committed to protecting your privacy and only using data to deliver the App’s core functionality.

Information we use

  • Precise location: Used to find nearby events and to calculate distance and drive-time estimates. Your location is used to provide the service and is not sold or shared with advertisers.
  • Alert preferences: Your chosen alert radius, timing and sound settings, stored so alerts work the way you want.
  • Notification history: A record of alerts you have received, so you can review and manage them in the App.

How we use information

Information is used solely to provide the App’s core functionality — finding nearby events, estimating reachability, and delivering timely alerts. We do not use your data for advertising or for tracking you across other apps or websites.

Legal basis (UK/EU GDPR)

Where GDPR applies, we process your location and preferences on the basis of performing the service you request and our legitimate interest in providing a functional, relevant product. You may withdraw location or notification permission at any time via your device settings.

Data sharing

We do not sell your personal information. Event data is provided by third-party event sources. We do not share your location or preferences with third parties for their own marketing.

Data retention

Alert preferences and notification history are retained while you use the App. You can clear your notification history at any time from the Notifications screen, and uninstalling the App removes locally stored preferences.

Your rights

Depending on your location, you may have rights to access, correct, delete or restrict the processing of your personal data. To exercise these rights, contact us using the details below.

Children

The App is intended for professional adult drivers and is not directed at children under 18.

12. Cookies Policy

The Burst mobile app does not use advertising or tracking cookies. It stores a small amount of data locally on your device (for example, your alert preferences) so the App can function — this is essential to the service and is not used to track you.

This website may use a limited number of cookies. Typical categories are described below:
